Inspired by this story.

The protagonist in the story claims that they are allergic to shellfish, which her sister knew about. One day when visiting her sister, her sister gave her a small bowl of food "in case she didn't like it". Said bowl contained shellfish, which landed the protagonist in hospital. Her sister exclaimed "I thought you were exaggerating!". Protagonist told her sister from the hospital bed that she's going to file attempted murder charges.

I'm wondering if she has a case. Legally, did her sister attempt murder by serving food she knew the protagonist is allergic to? If it is not attempted murder, did her sister commit any crime?

The scenario you describe does not include the necessary elements for murder or attempted murder in Canada.

In Canada, murder and attempted murder both require the subjective intention to kill.

Mere knowledge of an allergy is insufficient.
