I am a blueberry amateur planter. I met some retailer selling a rare "Russian breed" "Red Kalina" blueberry seeds. I suspect whether they are legally imported, because it is so rare and the seller is not blueberry farmer himself, but I do not have any evidence. Or of course there is possibility it is a deception and not "Red Kalina".

I want to know, if it is really the Russian patented breed, is there any law protecting it? Will there be any risk if I re-sell those seedlings or ripen fruits under "Red Kalina" name?

This question says I can reproduce them sexually without permission in and from USA/Canada. I want to confirm whether this comply to Russian plants too. Also if the seeds are smuggled, do I take more risks reproducing them (if I am not explicitly informed ahead that they are smuggled)?

I am only amateur. Any useful information is appreciated.

Check if "Red Kalina" is patented in Russia via international databases (UPOV, WIPO) or local authorities; patented varieties may restrict propagation/sale without licenses. In the US/Canada, foreign plant patents are not automatically enforced unless registered locally. Smuggled seeds risk violating import/agricultural laws (e.g., phytosanitary rules)—verify certifications before resale.
